Lovense E-Gift Card Terms and Conditions

These Lovense electronic Gift Card（hereinafter the “Gift Card”) Terms and Conditions apply in addition to the Lovense Terms and Conditions and Privacy Policy set forth on the Lovense.com website, which are expressly incorporated herein. The term “Lovense” shall be interpreted to encompass HYTTO PTE. LTD.( "we", "us", "our", and "Lovense"). By purchasing, accepting, or using a Gift Card, you agree to be bound by these terms and conditions on behalf of yourself and others who purchase, accept, or use a Gift Card under your Lovense account.

Redemption.

Gift Cards are issued by Lovense and are automatically added to your Lovense account when you applied to Gift Cards to your account. To view your Gift Card, visit Your Lovense account. Purchases are deducted from your Gift Card. If Your Gift Card is denominated in a specific currency, it can only be redeemed in countries or regions where that currency is accepted and supported. Gift Cards can only be used as a credit for the amount of the purchase and cannot be used to cover shipping charges. Any unused Gift Card will remain associated with your Lovense account. If a purchase exceeds your Gift Card(s), the remaining amount must be paid with another payment method.

Gift Cards may only be redeemed toward the purchase of eligible goods on www.lovense.com. Eligible goods are subject to change in our sole discretion. Lovense may provide Gift Card purchasers with information about the redemption status of Gift Cards that they purchase.

Nonreturnable; Nonrefundable; Not for resale.

Notwithstanding anything contained in these Terms and Conditions, Gift Cards are not returnable or refundable for cash except in states where required by law. Resale of Lovense Gift Cards is strictly prohibited.

Limitations.

Your Gift Card cannot be used to purchase other Gift Cards. Gift Cards cannot be reloaded; resold; used for payment outside of www.lovense.com; redeemed for more than face value; transferred for value; redeemed for cash; returned for a cash refund (except to the extent required by law). No portion of your Gift Card may be transferred to another Lovense account.

Risk of Loss.

The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission of the Gift Card to the purchaser or designated recipient, whichever is applicable. Gift Cards must be obtained from Lovense, and you are responsible for safeguarding your Gift Card from unauthorized use. We are not responsible if any Gift Card is used without your permission. There are a variety of Gift Card scams. Lovense is not responsible for, and assumes no liability to you for, any unlawful conduct or fraud by any third party associated with any Gift Card.

Use of any Gift Card in Violation of these Terms and Conditions.

By purchasing, accepting, or using a Gift Card, you agree to comply with these terms and conditions, and not to use a Gift Card in any manner that is misleading, deceptive, unfair, or otherwise harmful to Lovense, or its customers.

We reserve the right, without notice to you, to void Gift Cards without a refund, suspend or terminate your Lovense account, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if we suspect that a Gift Card is obtained, used, or applied to an Lovense account (or your Gift Card is applied to a purchase) fraudulently, unlawfully, or otherwise in violation of these terms and conditions.

Limitation of Liability.

TO THE FULL EXTENT PERMISSIBLE BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS. YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, WILL BE THE REPLACEMENT OF THAT GIFT CARD.

Lovense Gift Cards Do Not Expire.

Lovense gift cards never expire.

Disputes & Arbitration.

PLEASE READ THIS SECTION CAREFULLY. This arbitration provision provides that you and Lovense waive any right to file a lawsuit in court or participate in a class action for matters within its terms.

YOU ARE AGREEING THAT ALL DISPUTES ARISING OUT OF OR RELATED TO THE TERMS AND CONDITIONS OR ANY ASPECT OF THE RELATIONSHIP BETWEEN YOU AND LOVENSE, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL, SINGLE ARBITRATOR INSTEAD OF IN A COURT BY A JUDGE OR JURY, AND YOU AGREE THAT LOVENSE AND YOU ARE EACH WAIVING THE RIGHT TO SUE IN COURT AND TO HAVE A TRIAL BY A JURY. DISPUTE SHALL BE INTERPRETED AS BROADLY AS PERMITTED UNDER THE LAW AND SHALL COVER ANY CLAIMS THAT AROSE BEFORE THESE OR ANY PRIOR TERMS AND CONDITIONS. YOU AGREE THAT ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION.

Any Disputes shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The applicable law of this arbitration clause shall be Hong Kong law. The seat of arbitration shall be Hong Kong. The number of arbitrators shall be one. The arbitration proceedings shall be conducted in English.

General Terms.

Lovense reserve the right to change these terms and conditions without notice, from time to time at our sole discretion. If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining terms and conditions.In the event of a conflict between Gift Card Terms and Conditions and the Lovense Terms and Conditions set forth on the Lovense.com website, these Gift Card Terms and Conditions will govern.
